Incineration firm fined after worker burnt with hot ash

A COMPANY which runs New Cross’s incinerator has been criticised for
failing to protect a vulnerable worker who was severely burned with hot
ash.

City of London Magistrates’ Court heard how the employee sustained 17
per cent burns whilst cleaning ash from a filtration hopper at Veolia
Environmental Services’ Landmann Way plant on December 29 2009.

Ash fell onto him after he went into the hopper and started prodding it
with a rod to clear a blockage. The burns he sustained left him
hospitalised for a month.

An investigation by the Health and Safety Executive (HSE) into the
incident found Veolia did not follow its own policies and procedures for
the management of dangerous tasks, putting a vulnerable worker at risk
by failing to provide him with adequate information or supervision.

The court heard the eastern European employee spoke little English and
had not been properly briefed in the plant’s working practices.

Veolia pleaded guilty to breaching the Health and Safety at Work Act and
was fined £5,000 and ordered to pay £12,243 costs.

After the April 27 hearing, HSE inspector Kerry Williams said: “The
victim was a vulnerable worker who should have been protected whilst
working for Veolia.

“However, he wasn’t provided with the basic information, training or
supervision to allow him to complete his job safely. As a result he was
badly exposed and he sustained severe burns in an incident that could
easily have been avoided.

“Veolia operates a high hazard site and as such should ensure its
systems are sufficiently robust to ensure people are not placed at
unnecessary risk.”

A Veolia spokesman said: “We deeply regret this incident and the
injuries sustained by the person concerned and immediately put in place
changes to our operating procedures to further improve our safety
systems relating to any work carried out by contractors on site.

“As a company we are committed to the highest standards of health and
safety and this remains our first priority as is evidenced by continual
improvements in our safety performance.”

Co-ordinate on waste disposal

The Legislative Council’s environment panel made the right decision (“Bureau ditches HK$15b incinerator funding bid”, April 21).

The proposed Shek Kwu Chau incinerator posed an unacceptable risk of irreversible and ongoing health and environmental damage from air and marine pollution, with the high cost and risk involved in reclamation and transporting waste by barge. It had too many negatives.

Perhaps the Hong Kong and Guangdong governments could co-ordinate the disposal and recycling of their waste. In this way, they could harness available synergies, raise standards to their mutual benefit and achieve optimum management of Hong Kong’s waste, including harnessing energy from incineration into the electrical grid for domestic electricity consumption.

In the short term, perhaps Hong Kong could investigate the possibility of leasing capacity from waste incinerators in Guangdong, including at the world’s largest incinerator, to be built at Shenzhen.

The Hong Kong government should also liaise with Guangdong to minimise the health and environmental impact of Guangdong’s waste incinerators on Hong Kong.

Better still, maximise recycling and view all waste as a resource. With the right approach, there is “gold in garbage”.

Environment Bureau, ‘experts’ ignore alternatives to waste incinerator

I found it interesting that Professor Poon Chi-sun, director of Polytechnic University’s research centre for environmental technology and management, has remarked of the waste incinerator issue that the current discussion by lawmakers “has become politicised” and is “not rational” (“Two ways to burn our trash, both with flaws”, April 22).

This follows legislators’ refusal to support the incinerator plan, and the Environment Bureau’s withdrawal of its funding request. Yet the issue has long been politicised and irrational.

In 2005, an incinerator was proposed as part of a comprehensive waste strategy introduced by the government. Though the strategy appeared rational, politics soon led to proposals being watered down or sidelined until incineration emerged as pivotal for the city’s waste management.

A proposed mega-incinerator was given the fancy-sounding title of “integrated waste management facility”, even though it was not integrated and would be little but a glorified bonfire. Incredibly, a site selection process led to the preferred location being an artificial island to be built beside Shek Kwu Chau, in a beautiful coastal location that’s a prime site for the globally endangered finless porpoise.

Various reasons were given, among the more ludicrous being that the incinerator island would boost local tourism. Yet the real reason for preferring Shek Kwu Chau was surely political: there’s no nearby major population centre with people who might protest.

A rational debate over the incinerator would surely involve the Environment Bureau and its consultant giving a balanced view of the pros and cons of the project.

Instead, information has been more akin to propaganda, with incineration touted as being near perfect – even though cases worldwide show there are abundant problems, including poisonous emissions and toxic ash – and alternatives derided or dismissed out of hand.

Plasma gasification is among these alternatives. It has been left to incinerator opponents to uncover information on this and other options.

Sadly, even waste “experts” receiving government funding have been far from immune from politicization, seeming too prone to support the incineration-focused policy under Chief Executive Donald Tsang Yam-kuen and too ready to downplay or provide disinformation about ways to treat trash without primitive bonfires.

Job No 1 for Leung: replace Yau

Now that the Legislative Council’s environment panel has voted down funding for the proposed incinerator at Shek Kwu Chau, one of Leung Chun-ying’s first tasks as chief executive should be to remove Edward Yau Tang-wah from the position of environment minister.

The name of the Environmental Protection Department is inappropriate.

It has allowed our air quality to deteriorate and wasted millions planning a giant incinerator that would have worsened air pollution and trashed an area of unspoilt countryside.

There has been much talk about how Mr Leung needs to earn the support of the civil service and the public. Hong Kong has lacked leadership in recent years, and a leader gains support by earning respect. He must very publicly replace the under-achievers who are at present cluttering up our civil service.

This would put much needed accountability and fear of retribution into our cosseted bureaucrats and, at the same time, win instant support from the city’s frustrated citizens.

Mr Yau, in particular, has wasted years dithering over an unenforceable ban on idling engines while ignoring pollution, environmental degradation and waste disposal.

We have become a laughing stock, with stories running in the international press portraying the SAR as the world’s dirtiest financial centre, which produces more rubbish per capita than anywhere on earth.

Yau and others remind me of the department head in the British comedy television series Yes Minister: “My department is not expected to do things; we are just here to explain why things cannot be done.”

Planned incinerator would have damaged environment

The Environmental Protection Department must be feeling disappointed that its plans for a super-incinerator on Shek Kwu Chau have now been put on hold (“Bureau ditches HK$15b incinerator funding bid”, April 21). However, the department’s arguments have been flawed all along.

It refused to consider the more modern plasma arc technology, with almost zero emissions. It also completely missed out on one of the major benefits of any incinerator – using the energy generated to produce electricity and hot water for the local community, something that the location on Shek Kwu Chau negated.

It ignored the fact that the pollution caused by transporting rubbish to Shek Kwu Chau, and the remaining 14 per cent of toxic sludge back to landfills, would have neutralised any environmental advantage brought about by its remote location.

Department officials ignored the obvious cost and environmental benefits (less transportation equals less pollution) of utilising the already besmirched Tsang Tsui ash lagoons site.

Most shockingly of all, they completely failed to see what was wrong with placing a massive industrial facility on an unspoilt island, in an area of untouched pristine natural beauty. Once it is destroyed, it is gone forever.

In all the years of planning for this incinerator, there has been no meaningful attempt to force households to separate their waste and recycle, now standard practices in Europe and in Japan, Korea and Taiwan.

Other countries have been able to achieve substantial reductions in the amount of household waste generated and this drastically reduced the need for an incinerator.

There is no glass recycling in Hong Kong, apart from a few tiny operations. Also, no effort has been made to produce a meaningful air quality index, or cut air pollution on our streets, with the exception of introducing liquefied petroleum gas taxis.

If you can ask for HK$14 billion for one incinerator, why not come up with a concrete plan to spend public money on sponsoring the replacement of all the old polluting vehicles in Hong Kong? Or how about introducing electronic road pricing to get private cars off the roads, and pay for the replacement of old vehicles?

Sorry, Environmental Protection Department, if you want the Hong Kong people to believe that you are really committed to protection of the environment, then you are going to have to step up your game.

Recycling the key to waste policy

The outgoing government has bowed to political reality by abandoning its request for financing for a controversial waste incinerator at the first legislative hurdle – an environmental panel of lawmakers. Incoming chief executive Leung Chun-ying had already pre-empted the plan by vowing to review the role of incineration in a waste-disposal strategy. As a result, lawmakers across the political spectrum withheld support for an incinerator and landfill expansion in favour of leaving the issue to the next government.

That does not mean a major role for incineration in tackling Hong Kong’s mounting waste problem is off the agenda. There are three ways of dealing with waste – landfills, incineration and recycling, which remains at a rudimentary stage in this city. None can solve the problem without integration with the other two, although incineration, using the latest technology, alongside recycling may be the best way forward.

As lawmakers and waste experts have observed, putting off a decision for up to a year would not be a disaster. The landfills now used for burying our waste will not be filled until 2018. But given the lead times for building an incinerator and expanding landfills, the new government will have to bite the bullet sooner rather than later.

The outgoing government fast-tracked its incinerator plan after lawmakers refused to approve the expansion of the Tseung Kwan O landfill by five hectares into the adjacent Clearwater Bay Country Park. As a result, the government lurched from one confrontation with local opposition to another. But lack of progress cannot all be blamed on the not-in-my-backyard syndrome. Local opponents of a HK$15 billion plan to put an incinerator on Shek Kwu Chau off the south coast of Lantau Island found support from the green movement over environmental issues. And the incinerator did not form part of a viable integrated waste strategy. The ultimate environmental issue in this case is how one of the world’s most wasteful societies, in terms of municipal solid refuse per capita, is going to dispose of waste. For the Leung administration, developing a credible integrated strategy, with a recycling culture at the centre, must be a priority. This will call for political skill and persuasion in selling it to the community and lawmakers. Public consultation will not find consensus – only the need for strong leadership.

Recycling that begins with sorting of refuse at source is key to credibility. We have been used to washing our hands of our rubbish for too long. As a result we lag behind cities we should be trying to emulate – like Tokyo and Taipei – that have fewer constraints on space, but have convinced their communities that recycling coupled with incineration is the way forward. Incineration may not be an alternative in itself to landfill, but it is integral to a waste programme based on recycling.

Ministry sued for failing to provide pollution data

A man is preparing to sue the Ministry of Environmental Protection for failing to provide information about the emissions from an incineration factory, which, he claimed, paralyzed his son’s brain.

Xie Yong, from Hai’an county, Nantong, in Jiangsu province, said he plans to sue the ministry to force it to disclose the information. He claimed that the pollution caused his 4-year-old son’s brain paralysis and epilepsy shortly after he was born.

Xie said he will formally sue the ministry at the High People’s Court of Jiangsu once materials are prepared.

Xie claimed that his son’s condition was caused by poisonous gas, flying ash, cinder and waste liquid released by the incineration plant, located 200 meters from his home.

In June 2010, Xie sued the factory at a county-level court, but lost the case because he had no evidence to support his accusation, he said.

He then asked the local environmental protection bureau to provide data about the plant’s emissions. The bureau rejected his request.

He then asked the Ministry of Environmental Protection for access to the emissions information, but that request was also turned down. The ministry said it was the environmental protection bureau’s duty to monitor and supervise an individual factory, according to Xie.

That prompted him to think of suing the ministry.

“Taking the ministry to court is my last choice,” said Xie. “It’s the only way I can get justice.”

The ministry did not comment. The case is seen by environmentalists and lawyers as signifying a rising awareness of environmental protection by the public. Very few people have sued the ministry for failing to provide pollution information.

“It’s the first time a victim of a waste incineration factory has stood up to fight for his rights,” said Liu Jinmei, a lawyer with the China University of Political Science and Law’s Postgraduate Legal Assistance Center. “His efforts indicate a growing awareness of safeguarding the rights of victims of pollutants.”

The center is helping Xie draft indictment documents.

The Hai’an bureau of environmental protection said it did not release much information about the plant because “we can only release some of the information for fear of leaking business secrets”.

“We are just acting according to regulations,” said Gu Shihe, director of the bureau.

Gu said the bureau asked the city and provincial environmental protection authorities for instructions, but they did not reply.

Xie said he has spent 80,000 yuan ($12,700) to treat his son, a huge amount for a family that earns about 3,000 yuan a month.

Green Beagle, a Beijing-based non-governmental environmental protection organization, has helped Xie raise 7,200 yuan in donations.

But the money raised so far is still far from enough to cover medical bills and further treatment for his son, said Chen Liwen, a researcher with Green Beagle.

Liu said she hoped Xie’s case could help enhance people’s awareness of the potential hazard of incineration plants, which are mushrooming across the country to deal with the growing amount of household garbage.

Incineration plants, which use less land than landfills, are generally safe, but strict supervision must be imposed to make sure they are operated in accordance with regulations, said Mao Da, an expert in solid-waste management at Beijing Normal University.

Dioxins, which may cause cancer, may be released if an incinerator fails under a high temperature, Mao said.

The rubbish-burning facility that the government hopes will finally win over lawmakers would use a “moving grate” system, in which a grate carries a steady flow of waste through a high-temperature furnace. Present in more than 900 plants globally, it is one the world’s most common waste-to-energy technologies.

But the system has drawn criticism from some environmentalists who prefer more advanced technologies, such as plasma gasification, an option that officials rejected.

Hong Kong closed the last of four incinerators in 1997, after the colonial government weighed the effects the facilities had on the environment and public health. But they are being considered once again, and a proposal to build an incinerator at Shek Kwu Chau south of Lantau, at a cost of HK$15 billion, has been heavily pushed by the environment chief, Edward Yau Tang-wah. Yau argues the city has no other viable alternative to incineration.

The project will fall to the next administration after the Environment Bureau withdrew its funding request from the Legislative Council on Friday amid a lack of support from lawmakers. Incoming chief executive Leung Chun-ying has yet to officially state his view on the plan, although Yau says the new leader will have no choice but to support it.

“I recommend Hong Kong’s first plant be one that uses the moving grate technology,” he says. This is based on comparing the reliability, robustness, economics and environmental impact of the different technologies.”

Poon says other emerging incineration methods, such as plasma gasification, could be considered if a second plant was needed in the future, presumably after such technologies became more mature. He nonetheless concedes that the ash produced by a moving-grate incinerator was a concern, though one that could be addressed.

The government also weighed costs in its decision. A government-commissioned study found a moving-grate incinerator would be cheaper to build and run.

The government had said it wanted a “state-of-the-art” facility to burn 3,000 tonnes of municipal solid waste daily, which would make the incinerator the biggest of its kind in the world. An advisory group at first recommended the project should adopt a multi-technology approach because of the complex nature of the city’s waste, but a 2009 review concluded moving-grate technology should play a central role.

The technology is used in incinerators throughout the world, including in 420 of Europe’s 450 facilities. Environmentalists oppose the method because it requires a constant flow of trash to keep the fires burning, a process they say would discourage waste-reduction efforts and possibly motivate the city to generate more waste.

In such a system, waste moves through a combustion chamber heated to 850 degrees Celsius to achieve the most efficient and complete burning possible. Heat from the burning waste runs a boiler, which produces steam to create electricity.

The heaviest ash produced by burning the rubbish – called bottom ash – falls into a collection point and is passed over with an electromagnet to extract metal for recycling. Flue gases containing fine ash are then passed through a scrubber reactor to remove dioxins and other compounds that contribute to acid rain.

The government says the plant would boast “the most advanced flue-gas-treatment system” in the world. Nonetheless, environmentalists say they are concerned smoke and ash would pose a health risk, especially to nearby residents.

The government also studied plasma gasification, a more advanced, chemical approach. It relies on a high-energy plasma arc that creates temperatures ranging from 3,000 degrees to 7,000 degrees to break down organic matter primarily into syngas – a mixture of carbon monoxide and hydrogen – and solid waste.

An electrode is lowered into the plasma converter and gas and solid material is fed into the chamber.

Clean exhaust gases are produced which are then used to power generators. The rest of the material solidifies into what is called plasma rock.

The rock is broken down and used in construction and road building.

While the technology shows promise, not enough is known about its emissions, Poon says. Plasma gasification may seem better for the environment because it produces less ash and emission than other incineration methods, but its long-term reliability has yet to be proven.

A moving grate system can handle almost all kinds of municipal solid waste, while plasma gasification requires the waste to be sorted and ground beforehand to ensure a good thermal process.

“The current discussion by lawmakers has become politicised. It’s not rational. It doesn’t get us any closer to solving the waste problem,” Poon says. “There’s nothing we can do about it except to wait, but we don’t have much time. People may say the governments in the past did not do enough, but that doesn’t change the fact that it’s a problem that has to be dealt with now. Whatever the history, we have to do both: incineration and waste reduction. Not either.”

Environmentalists oppose the method because it requires a constant flow of trash to keep the fires burning, a process they say would discourage waste-reduction efforts and possibly motivate the city to generate more waste.

In such a system, waste moves through a combustion chamber heated to 850 degrees Celsius to achieve the most efficient and complete burning possible. Heat from the burning waste runs a boiler, which produces steam to create electricity.

The heaviest ash produced by burning the rubbish – called bottom ash – falls into a collection point and is passed over with an electromagnet to extract metal for recycling. Flue gases containing fine ash are then passed through a scrubber reactor to remove dioxins and other compounds that contribute to acid rain.

The government says the plant would boast “the most advanced flue-gas-treatment system” in the world. Nonetheless, environmentalists say they are concerned smoke and ash would pose a health risk, especially to nearby residents.

The government also studied plasma gasification, a more advanced, chemical approach. It relies on a high-energy plasma arc that creates temperatures ranging from 3,000 degrees to 7,000 degrees to break down organic matter primarily into syngas – a mixture of carbon monoxide and hydrogen – and solid waste.

An electrode is lowered into the plasma converter and gas and solid material is fed into the chamber.

Clean exhaust gases are produced which are then used to power generators. The rest of the material solidifies into what is called plasma rock.

The rock is broken down and used in construction and road building.

While the technology shows promise, not enough is known about its emissions, Poon says. Plasma gasification may seem better for the environment because it produces less ash and emission than other incineration methods, but its long-term reliability has yet to be proven.

A moving grate system can handle almost all kinds of municipal solid waste, while plasma gasification requires the waste to be sorted and ground beforehand to ensure a good thermal process.

“The current discussion by lawmakers has become politicised. It’s not rational. It doesn’t get us any closer to solving the waste problem,” Poon says. “There’s nothing we can do about it except to wait, but we don’t have much time. People may say the governments in the past did not do enough, but that doesn’t change the fact that it’s a problem that has to be dealt with now. Whatever the history, we have to do both: incineration and waste reduction. Not either.”

The Environment Bureau has abandoned its HK$23 billion funding request for what it says is an urgently needed waste incinerator and landfill expansion after failing to gain the support of lawmakers from across the political spectrum yesterday.

The controversial waste plans, which included building a waste incinerator on Shek Kwu Chau off the south coast of Lantau, will face uncertain delays when they are left to the next government to decide as requested by lawmakers at an environment panel meeting.

Despite the government’s warnings, one waste expert said Hong Kong would not immediately plunge into a waste crisis, but it would be wise for the city to start at least one landfill expansion to ease pressure.

Panel members refused to support the bureau in filing its funding request to the public works subcommittee and Finance Committee.

Some members cited concerns over government transition, following a remark by chief executive-elect Leung Chun-ying on the role of incineration, while others criticised the government for its poor performance on recycling and waste reduction.

“Without the support of the panel, the current administration is unable to file the funding requests within this term and complete all the relevant processes,” the bureau said.

It said it was unfortunate that the plans, including the HK$15 billion waste incinerator and HK$8 billion for expanding landfills in Tseung Kwan O, North District and Tuen Mun, had not been backed by the panel despite intensive discussions.

Environment minister Edward Yau Tang-wah failed to convince lawmakers that the waste plans were essential regardless of who led the next government, and were needed before all landfills were full by 2018.

“Is it necessary to bring everything to a halt just because there is a new government?” he asked the panel.

Lawmaker Gary Chan Hak-kan, from the Democratic Alliance for the Betterment and Progress of Hong Kong and chairman of the environment panel, said Yau was still free to table the funding requests at his own risk.

He can still ignore the panel’s advice and submit the funding applications,” he said. “There was a similar case when the Home Affairs Bureau sought funding for the Asian Games, but the request was still rejected.”

Chan said he might be willing to consider funding requests for less controversial landfill expansion plans in Tuen Mun and North District, but excluding Tseung Kwan O.

Democratic Party lawmaker Kam Nai-wai said there would be no disastrous consequences in delaying the plans for six to nine months, pending further discussion with the new government.

Legislator Tanya Chan from the Civic Party appeared sympathetic to the government despite not being able to lend support. “I understand there might be a need for an incinerator as it can extend the landfill life. But it might delay action on other waste reduction initiatives.”

Professor Jonathan Wong Woon-chung, a waste expert from Baptist University, said a delay of a year would only have a small impact on the overall waste problem.

Wong said the delay might give the government more time to come up with effective waste reduction strategies involving waste-charging schemes. But he believed an incinerator was part of the waste solution.

The city sends about 13,800 tonnes of waste each day to landfills – the only waste disposal outlets in Hong Kong.

Is it now the time that Edward Yau was held accountable for the incinerator disaster, failure to mandate source recycling, worsened roadside pollution during his tenure  and no shipping emissions control area –  and past due time Yau resigned or was fired?

Is it time AECOM (now out of a contract ?)  listened to their USA office’s Mike Zebell  and promoted plasma gasification to the incoming administration ?

Perhaps Elvis Au can now spill the beans?
